RESERVATION TERMS & CONDITIONS

These terms and conditions are between you and AC Cars (England) Ltd (“us or we”).

By paying the £2,500 Expression of Interest fee from this website, you are registering your interest in an AC Cars vehicle. Our staff will contact you within four weeks to assist you and complete your reservation. The Expression of Interest fee will either be deducted from the Reservation Fee when you formally reserve an AC Cars vehicle or it can be refunded to you within four weeks if you confirm in writing that you do not wish to make a Reservation.

Reservation is complete only once the full Reservation Fee of £25,000 has been received by the Supplier in cleared funds. By paying the Reservation Fee you are securing your place in our production line for the next two years. After receiving the payment of your Reservation Fee, we will start to develop and configure together with you, over a period of up to four months and through regular meetings, your AC Cars vehicle, and we will finalise your vehicle into a 3D model. Based on this, you will be invited to place your order within an Order Window of six months from the date of payment of the Reservation Fee.  The Reservation Fee will be deducted from the purchase price when you formally order your AC Cars vehicle or can be refunded within the Order Window to you if you confirm in writing that you do not wish to proceed to make a formal order. In this case, we reserve the right to retain 10% of the standard £25,000 Reservation Fee (equivalent to £2,500) as compensation for the administrative costs of processing your reservation.

If we have not heard from you before the end of the Order Window, the Reservation Fee will not be refunded. Refunds are made to the individual who has paid the Reservation Fee and to the card used to pay the Reservation Fee. If we are unable to take a formal order within the Order Window for reasons outside of our control, your Reservation Fee will be returned in full.

Any marketing materials indicating price, specification, options, or performance may be subject to change.
These terms and conditions govern your payment of the Reservation Fee only. Any order for an AC Cars vehicle will be subject to additional terms and conditions which will be made available to you at the time you place your order. Your ability to place an order is subject to status and your ability to pay the purchase price for the vehicle you wish to order.
We reserve the right to vary or cancel these terms and conditions without notice, however, when there is a change, we will use commercially reasonable efforts to notify you in advance, but this may not always be possible.

Where a Reservation Fee is refunded to you, we will only be liable for the sum received and we have no responsibility to pay you interest of any kind for the duration of the time that we hold the Reservation Fee. We accept no liability for interest charges even where you have used credit to pay the Reservation Fee.

Any requested refunds will be made as soon as reasonably possible following receipt of a request.

Our maximum liability to you under these terms and conditions will be the sum of the Reservation Fee that you have paid to us.

These terms and conditions are governed exclusively by Swiss law and the courts of Switzerland shall have exclusive jurisdiction over any disputes that arise between you and us.

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and AC Cars (England) Ltd. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of AC Cars (England) Ltd.
